Trading Terms & Conditions Elliott O’Callaghan Ltd T/A The HandCrafted Market
These regulations apply to all stallholders. Strict compliance with them is a condition of the contract for the hire of a stall on an event.
It is essential that all stallholders cooperate and play their part in ensuring that The HandCrafted Market events are enjoyable and safe for everyone. This includes complying with the commercial and administrative terms (especially regarding bookings and payment), the insurance terms, trading standards guidelines, food hygiene and the risk management and accident prevention terms.
Applications/Bookings:
- Stallholders are invited to apply to trade for any event on our website.
- Stallholders are invited entirely at the Management’s discretion. Do not assume a monthly pitch is automatically yours.
- Confirmation of a successful application will be emailed to you usually within 48 hours of applying. No stall is confirmed until this email has been received.
- You must apply for markets using the craft category assigned to you in your welcome email confirming your registration. If you apply under a different craft type because your assigned one is fully booked, we will not refund your original payment. Instead, your online account will be credited with the amount paid to use against a future application.
Payment:
- Payment must be made in full at the time of applying for a market.
- You can pay by credit/debit card during checkout, or choose to pay via BACs.
- If you choose BACs, you have 24 hours to make payment. If no payment is received within that time, your stall space will be released and made available to other traders.
- We no longer accept cheques.
- There is no facility for late or delayed payments.
Account Credit:
- Any credit issued to a stallholder’s account is valid for 12 months from the date of issue.
- Credit will automatically expire after 12 months and cannot be extended or reinstated.
- Account credit:
- Has no cash value
- Is non-refundable
- Is non-transferable
- Can only be used against future bookings with The HandCrafted Market
Stallholder Cancellation and Refunds:
- The only way to cancel your booking is by following the online process outlined in our help centre. You’ll need to log in to your account, go to ‘Orders’, select the booking you want to cancel, and follow the cancellation steps. You’ll receive an automated confirmation once submitted.
- Cancellations must be made no later than 21 days before the event to be eligible for a refund, minus a £15 admin fee.
- If you cancel within 21 days of the event, we regret that we are unable to refund you.
- Extenuating circumstances will be considered at the management’s discretion.
- Pitches cannot be re-let.
- Stallholders must accept the risk of bad weather and will not generally be entitled to a refund for these reasons.
Market Cancellation by Managment:
- If The HandCrafted Market is forced to cancel an event for any reason (including, but not limited to, weather, safety concerns, venue issues, or circumstances beyond our control) we will endeavour to notify stallholders a minimum of 24 hrs prior to the market.
- Stallholders may choose one of the following options:
- Refund option
- A refund of the stall fee minus a 35% administration fee.
- Credit option
- 100% of the stall fee credited to the stallholder’s account for use against future markets.
- Credit will be valid for 12 months from the date of issue.
- Refund option
- No additional compensation will be offered.
Trading Hours:
- Please check the individual market application form for exact timings.
- We require all stallholders to remain at the market and not pack down their stall until the allotted time, unless otherwise agreed with one of the management team.
- If food/drink stallholders sell out, you must place a sold out note on your stall and may be permitted to pack down early provided it does not cause disruption to other stallholders or the public and has been agreed by a member of the management team.
- Any stallholders who pack down and leave before the event ends and have not had permission from the management team will have any future bookings terminated and your account will be deactivated.
Pitch and Set Up:
- Management is solely responsible for the allocation and position of pitch sites.
- Indoor single stall spaces are 2.5m x 1.5m, double stalls are 5m x 1.5m, unless otherwise stated on the event page.
- Outdoor single stall spaces are 3m x 3m, double stalls are 6m x 3m, shared spaces are 3m x 1.5m, unless otherwise stated.
- No electricity will be provided for outdoor stalls.
- If you have a specific request for pitch location etc please make this clear on your application form.
- Management will do their best to cater for any special requests made, but we cannot guarantee this every time.
- Stallholders must only use the space designated for them by the management team unless otherwise agreed.
- Stallholders must ensure their stall is set up safely and correctly. It is essential that all walkways are free from obstructions or trip hazards and any stock/decoration hanging or stacked is secure.
- Sharing/subletting of your stall is not allowed.
- It is not permissible for stallholders to change the pitch position without consultation with the Management.
Gazebos & Temporary Event Structures (Stallholder-Owned)
- Stallholders bringing their own gazebo must use a commercial-grade pop-up gazebo.
- Domestic or lightweight gazebos are not permitted.
- All gazebos must be secured with appropriate weights on every leg.
- Minimum weight requirements may be set per event and must be followed.
- Gazebos that do not meet safety standards will be refused permission to trade, with no refund.
- Stallholders are responsible for the safe erection, stability, and condition of their gazebo at all times.
Gazebos Hired from The HandCrafted Market
- Nothing may be attached, fixed, taped, clipped, or tied to the gazebo frame or canopy.
- Stallholders must inspect their allocated gazebo on arrival and report any damage to market management immediately.
- Any damage identified after the event will be charged to the stallholder(s) allocated to that gazebo.
- Charges will reflect the full cost of repair or replacement where required.
Site Use and Presentation:
- Stallholders must operate strictly within the marked boundaries of the stall site that has been allocated to them, and avoid encroachment into neighbouring trader pitch space. Additional tables, clothes rails, display stands etc must fit within the allocated space.
- The presentation of stalls must be of a professional standard that is satisfactory to the Management. If we are not satisfied with the overall appearance of your stall, you may be asked to revise and revamp your set-up before being invited back. We are happy to help and advise you if you feel you need some support in this area.
- All stalls must have a table cloth that goes down to the floor on three sides.
- Traders supplying their own infrastructure must ensure that it is good quality and weighted appropriately.
- Approval to use a portable generator can only be given by the Management and only in exceptional circumstances.
- Gas safety certificates must be provided for all gas appliances.
Eligible Goods:
- On registration, stallholders are to supply a description and photographs of the goods intended for sale. Any additions/amendments to this portfolio must be approved by Management.
- Management will ask for any non-authorised goods to be removed from display.
- The Management reserves the right to refuse the sale of goods that are not in accordance with our standards or deemed inappropriate for our events.
- All stock, if required, must have the correct CLP, CE, UKCA or safety labelling attached to items. (i.e. wax melts, bath bombs, children’s items).
- Fur products are prohibited, as are counterfeit/copyrighted goods, weapons and any illegal items or substances.
Food Requirements:
- Food stallholders must rely on their own public liability insurance to include cover for claims arising from the sale of hot food or from food contamination.
- Food stallholders must acknowledge and agree that the Management is not liable for any worker’s compensation claim by any of their staff.
- In the storage, preparation, cooking and service of food, food stallholders must comply strictly with all legal requirements and/or the recognised best practice standards including, but not limited to:
- Holding a valid Food Hygiene Certificate and also being registered and inspected by their local Environmental Health Office.
- Goods must be marked and priced according to legal requirements.
- Alergen advice must be available for every product.
Alcohol Requirements:
- Alcohol may only be sold by stallholders who have declared the sale of alcohol when booking and have been granted permission by the management team.
- Stallholders MUST apply for a TEN as the event is NOT licensed for sale of alcohol. A copy of your approved notice must be sent to us a minimum of 48 hours before the market. You must also have a copy with you on the day for inspection.
- All sales of alcohol must be made in accordance with Challenge 25 guidelines and stallholders must display a ‘Challenge 25’ sign on your stall.
- All alcohol sales are for consumption off the premises.
Candles, Wax Melts and Home Fragrances:
- All products must have correct CLP labeling and safety notifications.
Cosmetics (including soap and bath products):
- Must be assessed for human safety by a qualified pharmacist, correctly labelled with a full ingredients list, and registered on the EU Portal for cosmetics (which is accessible by all health professionals across Europe, in case of adverse reaction).
- Please have a copy of the front sheet of the safety assessment with you on the day.
Children’s Toys:
- All stock, if required, must have the correct CE, UKCA or safety labelling attached to items in line with the latest legislation.
Exclusive Trading Rights:
- The Management will endeavour to prevent duplication of products within the event but does not guarantee exclusivity.
Smoking:
- Smoking is not permitted indoors or in the vicinity of the stalls.
Setting Up, Closing Down, Loading And Unloading:
- Stallholders must set up, close down, load and unload strictly within the specified times and guidelines given for each event.
- Trader vehicle parking is set out in the Set Up Instructions for each event. It is imperative that these instructions are followed.
- Before leaving their stall site, stallholders must dispose of all rubbish and take necessary steps to ensure the site is left in its original condition.
- Stallholders are required to remove and take away their own trade waste.
Bad Weather And Other Disruptions:
- The HandCrafted Market events operate in all weathers and will operate on the designated market day unless extreme weather or other disruptions that are beyond the Management’s control compel the Management to close the markets for the safety of traders and the public.
- The Management will communicate the cancellation of an event via social media and an email to the stallholders booked onto the effect event.
Management’s Directions:
- Stallholders must comply with all directions given to them by the Management.
- Stallholders must treat the staff of the Management, other stallholders and members of the public with courtesy and respect at all times.
- Any unacceptable behaviour including, but not limited to, nuisance/hindrance to other traders, aggression, abusive language or refusal to comply with a reasonable direction will be treated as a breach of a condition of these regulations.
- Such a breach is likely to result in that stallholder being required to leave the markets immediately and being banned from trading at any future markets.
- Any direction given by the Management regarding risk management or accident prevention must be complied with strictly and immediately.
Management’s Dispute Resolution Determinations:
- The Management may make determinations to resolve any dispute that may arise, including, but not limited to, disputes between stallholders and disputes between stallholders and customers or other members of the public.
- The Management’s decision is final.
Stallholders Warranties and Representations:
The stallholder acknowledges and agrees that, by applying to trade, the stallholder makes the following warranties and representations:
- That the statements made in the online application system are true, accurate and complete.
- That the stallholder has carefully read these regulations and agrees to be bound by their terms and conditions.
- That the stallholder has the full legal and beneficial ownership of the goods that they offer for sale and that their ownership is free of any encumbrances.
- That the stallholder will not engage in any false or misleading conduct including, but not limited to, selling counterfeit goods or mislabeling goods.
- That the stallholder has the necessary licences, practising certificates or permission to sell the goods that they offer for sale.
Inspection of Documents:
- Stallholders must supply all necessary documentation requested the first time they trade at an event, when renewed and when subsequently requested.
- Updated copies are to be sent when insurance renewal takes place.
Exclusion of The Management’s Liability:
The stallholder acknowledges and agrees that the Management has not given any warranties or made any representations relating to the stallholder’s occupation or use of a stall site at The HandCrafted Market other than as are specifically set out in these regulations. This includes, but is not limited to, any warranties or representations relating to:
- The stallholder’s likely sales or profits;
- The benefits of the location of any particular stall site;
- The number of potential customers that are likely to visit the markets;
- The presence of other stallholders on the same market day selling the same or similar goods or services or the location of their stall site;
- The services and facilities that are available to the stallholder other than as are expressly set out in these regulations;
- The extent to which the Management has carried out marketing or advertising to attract customers to the markets;
- The suitability of the markets for any particular purpose;
Claims Against The Management:
The stallholder acknowledges and agrees that the Management is not liable for any claims arising from:
- Damage to the goods or other property of the stallholder;
- Theft of the goods or other property of the stallholder;
- Injury, loss or damage suffered by any person at The HandCrafted Market events;
- The Management’s request for the trader to leave the market/ lack of future invitations to the event;
- Damage to or the theft of the property of any person at the markets.
Inspection of Insurance Policies:
- Stallholders must at all times have available copies of their Public Liability Insurance policies.
- Stallholders must have public liability insurance cover of £1M
Risk Management and Accident Prevention Terms:
- Stallholders must comply with the Management’s online bookings and payment procedures.
- Stallholders must report promptly to the Management any security problems including, but not limited to, robberies, shoplifting, pickpocketing, unusual packages or the need to forcibly remove drunken or belligerent customers from the events.
- Any stallholder using equipment or practices that could endanger the health & safety of any persons will be asked to leave the event.
Traffic Management & Vehicle Movement:
- Stallholders must comply with all traffic management arrangements in place for each event.
- All instructions given by Market Management, stewards, or authorised representatives must be followed at all times.
- This includes directions relating to:
- Vehicle access routes
- Arrival and departure times
- Loading and unloading areas
- Temporary road closures or restrictions
- Parking locations and restrictions
- Full details of traffic arrangements, access times, and any restrictions will be provided in the pre-event instructions email sent ahead of each market.
- Stallholders are responsible for reading and complying with all information provided in this communication.
- Vehicles must not be moved on site during trading hours unless expressly instructed by Market Management.
- Failure to follow traffic management instructions may result in:
- Delayed access to the site
- Refusal of vehicle entry
- Removal from the event
- No refunds or credits will be issued where enforcement action is taken due to non-compliance with traffic management requirements.
Tripping/Other Accidents:
- To reduce the risk of tripping accidents, stallholders must keep their stall site and the immediate vicinity clear of anything that might obstruct pedestrian traffic and cause tripping accidents.
- Stallholders must ensure that their stall sites are free of any sharp corners or dangerous projections that might injure customers particularly of hard materials such as timber, metal or glass.
Inactive Accounts:
- If a stallholder does not book onto a market or does not open or interact with our email communications within a 6-month period, their account will be classed as inactive.
- Inactive accounts will be automatically locked and removed from the mailing list.
- This process allows places within oversubscribed categories to be offered to stallholders on the waiting list.
- Locked accounts may request reactivation by contacting The HandCrafted Market.
- Reactivation is at the discretion of Management and may be subject to category availability and updated documentation being provided.
